Missing "Romantic Poetry" Creating Problems In Lawsuit Against Former Casselberry Police Chief

An attorney in a sexual-harassment lawsuit against the city of Casselberry and its ex police chief is now accusing the city of breaching public records law by failing to save romantic poetry that the chief composed and sent to a female employee.

 

When former Police Chief William McNeil resigned in October 2014, the city let him take his computer, cell phone and a thumb drive storing the poetry, according to a court document submitted by the plaintiffs. "It's our view that there were public records that should have been preserved and were not," said Carlos Burruezo, a lawyer for plaintiffs in the case against McNeil and the city of Casselberry.

 

A Seminole County judge on Thursday granted plaintiffs permission to amend their lawsuit within the next 10 days to include the new allegation. Burruezo said the revised complaint will also add a seventh plaintiff against the city, a former Casselberry police officer who claims she was targeted with an internal investigation and later fired after speaking with a news reporter about allegations of racist behavior within the department after McNeil left.

 

The city launched the internal investigation after hearing that officer Roselyn Martinez-Eck had yelled and cursed at a television reporter over the phone, according to an agency report. Martinez-Eck also sent profanity-laced text messages to the reporter, the report states. Martinez-Eck was off-duty during the exchange, the internal investigation concluded, but identified herself as a Casselberry police officer. The investigation determined that Martinez-Eck had shown conduct unbecoming an officer.

 

According to a draft of the amended complaint, Martinez-Eck also claims that while employed with the police department, she was treated "less favorably than white male officers." Burruezo said the complaint he will submit in coming days might vary somewhat from the draft. McNeil's attorney, Josh Walker, noted during Thursday's hearing that the new claims mentioned by Burruezo were against the city and not his client...MORE HERE.
